Back in July we learned that law offices of Chimicles, Schwartz Kriner & Donaldson-Smith had
opened a class-action investigation over the Nintendo Switch's Joy-Con drift issue — as several Nintendo Switch owners had been reporting that their controllers had begun to fail.
That very same week,
Nintendo addressed the Joy-Con drift issue by stating that they would be fixing faulty controllers completely for free; this is where it got tricky, as this only applied to some regions.
To make matters worse,
Nintendo had just revealed the Nintendo Switch Lite — which is a smaller, budget-friendly version of the original. The problem? The
Nintendo Switch Lite is a single unit without detachable Joy-Con controllers; meaning that, if the drifting issue were to show up, there is no way to fix said problem without sending the entire console.
As it turns out, only a few days after the new handheld console was released, some players had already begun reporting that the analog stick of their
Nintendo Switch Lite was drifting — which is terrible news for Nintendo, as the problem stems from use, not faulty units.
On account of users reporting drifting issues on their consoles, Chimicles, Schwartz Kriner & Donaldson-Smith have amended their class-action investigation and have recently added the
Nintendo Switch Lite to the list; stating that Nintendo has violated Warranty of Merchantability, Consumer Protection Acts, Consumer Fraud Acts, and Deceptive and Unfair Trade Pracitce Acts — to name only but a few of many more.
Nintendo better address this issue promptly, or things will get out of hand. It is already bad enough that
Nintendo Switch Lite owners are already reporting the issues with their analog stick a mere week after the console became available.
Users shouldn't have to send in their
Nintendo Switch Lite for repairs every time the issue comes back — which, again, is caused by continuous use; meaning that every unit will eventually get the infamous drifting issue.
